Terms of Service

By accessing or using VetAssistant AI (the "Service"), operated by NexGen Technologies ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. The Service is available to users who are at least 18 years old. By using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into this agreement.

VetAssistant AI is an artificial intelligence-powered educational tool designed to provide general information about pet care, including but not limited to: • General pet care guidance and tips • Breed information and characteristics • Nutrition and feeding recommendations • Behavioral advice and training suggestions • Product selection guidance IMPORTANT LIMITATION: VetAssistant AI is NOT a substitute for professional veterinary care. The Service cannot and does not: • Diagnose medical conditions or illnesses • Prescribe medications or treatments • Provide emergency medical advice • Replace consultation with a licensed veterinarian For any medical concerns, symptoms of illness, or emergencies involving your pet, you must contact a licensed veterinarian immediately.

3.1 Anonymous Usage Visitors may use up to 5 free questions without registration. Usage is tracked via a unique visitor identifier stored in your browser. 3.2 Prepaid Plans (B2C) Users may purchase prepaid question packages. Upon successful payment, you will receive a unique access code (format: VET-XXXX-XXXX) that can be redeemed to access your purchased questions. Access codes: • Are non-transferable unless explicitly permitted • Must be stored securely by the user • Cannot be recovered if lost (keep a backup) • Have no expiration date unless otherwise specified 3.3 Clinic Access (B2B) Veterinary clinics may access the Service through dedicated API keys provided upon registration. Clinic accounts are subject to additional terms as specified in their service agreement.

4.1 Pricing All prices are displayed in Euros (EUR) or US Dollars (USD) as selected by the user. Prices are subject to change, but any changes will not affect already purchased packages. 4.2 Payment Processing Payments are processed securely through Stripe, a PCI-DSS compliant payment processor. We do not store your credit card information on our servers. 4.3 Refund Policy • Prepaid Question Packages: Refunds are available within 14 days of purchase if no questions have been used. Once questions have been used, partial refunds may be issued at our discretion based on unused questions. • Monthly Subscriptions: You may cancel at any time. Refunds for the current billing period are not provided, but you will retain access until the end of your billing cycle. • Technical Issues: If you experience technical issues preventing you from using purchased credits, contact us within 30 days for a full refund or credit extension. 4.4 Chargebacks Disputed charges should first be addressed through our customer support at [email protected]. Unauthorized chargebacks may result in account suspension.

You agree NOT to use the Service to: • Attempt to obtain medical diagnoses or prescriptions • Submit false or misleading information • Use automated systems or bots to access the Service • Reverse engineer, decompile, or attempt to extract source code • Interfere with or disrupt the Service's infrastructure • Share access codes with unauthorized parties • Use the Service for any illegal or unauthorized purpose • Harass, abuse, or harm others through the Service • Transmit malware, viruses, or harmful code Violation of these terms may result in immediate termination of access without refund.

6.1 Our Content All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of NexGen Technologies or its licensors and are protected by international copyright, trademark, and other intellectual property laws. 6.2 User Content By submitting questions or content to the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process that content for the purpose of providing and improving the Service. We may use anonymized and aggregated data for research and service improvement. 6.3 AI-Generated Responses Responses generated by the AI are provided for informational purposes only. You may use these responses for personal, non-commercial purposes. Redistribution or commercial use of AI responses requires written permission.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: • Merchantability or fitness for a particular purpose • Accuracy, reliability, or completeness of information • Uninterrupted or error-free operation • Compatibility with your devices or software MEDICAL DISCLAIMER: The information provided by VetAssistant AI is for educational purposes only and should not be considered veterinary medical advice, diagnosis, or treatment. Always seek the advice of a qualified veterinarian for any medical questions regarding your pet's health. We do not warrant that the Service will meet your requirements or that any errors will be corrected. Your use of the Service is at your sole risk.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXGEN TECHNOLOGIES AND ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR: • Any indirect, incidental, special, consequential, or punitive damages • Loss of profits, revenue, data, or business opportunities • Personal injury or property damage resulting from your use of the Service • Any harm to your pet resulting from reliance on information provided by the Service • Any unauthorized access to or alteration of your data • Any third-party conduct or content OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless NexGen Technologies and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: • Your use of the Service • Your violation of these Terms • Your violation of any rights of a third party • Any content you submit to the Service • Your failure to seek proper veterinary care for your pet

10.1 Service Modifications We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation. 10.2 Terms Modifications We may update these Terms from time to time. The updated version will be indicated by an updated "Last Updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms. Material changes will be communicated via email (if provided) or through a prominent notice on the Service.

11.1 By You You may stop using the Service at any time. For subscription plans, cancellation procedures are available through your account settings or by contacting support. 11.2 By Us We may terminate or suspend your access immediately, without prior notice, for: • Breach of these Terms • Suspected fraudulent or illegal activity • Non-payment of fees • Extended inactivity (12+ months) Upon termination, your right to use the Service ceases immediately. Unused prepaid credits may be refunded at our discretion.

12.1 Governing Law These Terms shall be governed by and construed in accordance with the laws of Chile, where NexGen Technologies is registered. For EU/EEA users, applicable consumer protection laws of your country of residence will also apply. 12.2 Dispute Resolution Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of Chile, unless you are a consumer in the EU/EEA, in which case you may bring proceedings in your country of residence. 12.3 EU Consumer Rights If you are a consumer in the European Union, you benefit from mandatory provisions of consumer protection laws in your country of residence. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions.

13.1 Entire Agreement These Terms, together with our Privacy Policy and any additional terms for specific services, constitute the entire agreement between you and NexGen Technologies. 13.2 Severability If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. 13.3 Waiver Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. 13.4 Assignment You may not assign or transfer your rights under these Terms. We may assign our rights without restriction. 13.5 Force Majeure We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, or internet outages.
